Wow, looks like we've all gone through this. Now I have a wife that purchased items and have her signature on the UPS pad, but the husband said that he didn't give her permission to use the card. Does she send it back.... of course not. Can I please get the name of the collection agency as well as the form letter. By the way, this was a great article! Thanks!

Bummed

We have a chargeback on service provided and I'm pretty sure Visa/MC or whatever will side with them. It's pending after I've written my response letter to these pricks.

My question is how can I obtain this customer's home address so I can send a final letter demanding money if it comes to that? I doubt the CC processing people or bank will give that information.

Also I would like to know who to use for collections and templates for writing letters. Whether I win this case or not, I want to still charge the customer all the fee's I've incurred.

Can you send me the form letter template you use to type this below......I like this....

use a simple form letter that explains to the customer that they have wrongfully and fraudulently disputed charges and are now responsible to me for the full charge amount plus the bank chargeback fees. They are notified that they have thirty (30) days to pay in full, and if they do not, they will be placed with a third-party collection agency and their account will be reported to all credit bureaus as a delinquent collection account, severely damaging their credit rating for at least the next seven (7) years. The letter also explains that we will no longer accept a return of the merchandise as settlement for the debt and will only accept payment in full.

I too would like a copy of your letter and a good collection agency. I have a little bit of a different situation. I own a 4000 square foot luxury vacation rental on the Toccoa River in Blue Ridge, GA. It rents for $2700 per week during the summer months. We collect payment 30 days in advance of the arrival date and have a very clear policy on "no refunds" within 30 days of that arrival date because we turn away many other rental prosects once it is booked.

We have never had a dispute, a chargeback or a complaint in four years. This particular customer showed up on their arrival date, called us immediately saying that the house wasn't clean. When we inquired as to the exact issues with the cleanliness, they texted us a photo of the basement closet with some extra pillows on the floor. As strange as that was, we proceeded to have our cleaning crew there within 45 minutes and told the customer to point out anything they were unhappy with and the staff would clean it for them right away. They sent the crew away after berating them, being rude and hateful and never pointed out anything unclean.

It was extremely bizarre and evident that they had changed their mind within the last 30 days and this was how they were going to get out of the contract. They left, called Amex and said that they did not recognize the $2707 charge on their account. After further questioning from Amex, they changed their story to say that the left because the house was unclean. Despite all of my evidence (the full story, signed contracts, email correspondence, etc) Paypal failed to resolve the dispute and Amex sided with their customer. Unbelievable! I want justice and my money! Thanks!

You can tell that this guy named Mike above is just a two pit hustler merchant that most likely does rip-off customers. If I sent back a Tv and he kept it and my money I find out where he lives and beat the crap out of him. Ripping of merchants is not good but sometimes you got to go after thier pocketbook, because they hide behind lawyers and "corprate customer service addresses" that are only P.O. Boxes and when you do try to find out the corprarte phone number your told "they don't talk to customers" What are they to good to talk to a customer?

Well.. thank you very much for such prestigious information... Plus, I am looking for an advice regarding choosing Merchants... How can I find the best Merchant in the market? Plus, what should I check before signing up with it?

I am now getting fed up with my Merchant because they have started refunding the money without my permission. when I sent them an email to have an answer about it.... they said " to reduce Charge backs; we are refunding it" Sounds Funny... I know...

One day, I got several emails from them stating that following transactions have been charged back.. when I saw the purchase data; they were made at least 4 to 7 months ago... How can they be stopped?

any help will be appreciated....

Let me start by saying the article above reflects my feelings of the injustice of chargeback fraud and the fraudsters that commit them to a T. I have had so much heartache and headache in my business and thought I was just dealing with the nature of the business. This is just a little bonus for any unscrupulous merchants here as I figure this info should get around.

I recently had this happen to me from an online merchant and was denied a chargeback from citibank mastercard.

The merchant attached an after the fact (non-stated in terms and condition or shipping terms) COD charge for 20% higher than the total paid cost of the item. Refusal to accept this resulted in the merchant receiving the product back undelivered so viable for full resale value and allowed him to charge a 40% restocking charge which the credit card company refused to allow a chargeback on.

So if you want to make some easy money fast you can always just tack on a huge COD charge to a product slap on a 95% restocking charge or something like that and when they refuse you get your product back to resell and keep most if not all of the money they paid and everyone goes laughing to the bank (except the customer but thats the wonder of online sales, there's always more suckers).

I am the Sales Manager for a payment processing company! I am constantly asked how to prevent chargeback's. I feel it's my duty to clearly explain how to prevent chargeback's in order to protect their business. AND I must say... Our company really works hard to help each merchant fight any chargeback's that come in!!

It's not in the merchant's best interest to get a chargeback of course, and it's not in OUR best interest either! I have a basic outline of "how to prevent chargeback's" that I send to my processing merchants... THANKFULLY I finally decided to Google the subject..

Your article BY FAR out shines any others that have posted! I just wanted to thank you for your detail, honesty and experienced information! I know that it will really help a lot of merchants out! I'm sending the link to this page out right now.
